Terms of Service

Location 3 Times ("we", "us", "our", or the "Platform") is an automated video testimonial service for real estate professionals, operated from Ottawa, Ontario, Canada. The Platform enables subscribing agents to request, collect, publish, and share video testimonials from their clients.

By creating an account or using any part of the Platform, you ("you", "Subscriber", or "Agent") agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.

You must be at least 18 years of age to use Location 3 Times. By creating an account, you represent and warrant that:

• You are at least 18 years old
• You have the legal authority to enter into these Terms on behalf of yourself or your brokerage
• All information you provide is accurate and current

We reserve the right to suspend or terminate accounts that do not meet these requirements.

You are responsible for:

• Maintaining the confidentiality of your login credentials
• All activity that occurs under your account
• Notifying us immediately at info@location3times.com if you suspect unauthorized access

We are not liable for any loss or damage arising from your failure to keep your credentials secure.

Location 3 Times offers the following subscription plans (all prices in Canadian dollars):

All billing is processed securely by Stripe. Your subscription renews automatically at the end of each billing period. Applicable Canadian taxes (GST/HST) will be added at checkout based on your province of residence.

Prices are subject to change with 30 days' written notice.

Monthly subscriptions: You may cancel at any time from your account dashboard. Cancellation takes effect at the end of the current billing period. No partial-month refunds are issued.

Annual subscriptions: You may cancel at any time. If you cancel within 14 days of your initial annual payment and have published fewer than 5 testimonials, you may request a full refund by emailing info@location3times.com. After 14 days, annual subscriptions are non-refundable.

Free plan: No billing, cancel at any time by deleting your account.

Upon cancellation, your published testimonial pages will remain live for the remainder of your paid period. After expiry, pages will be taken offline but your data will be retained for 90 days in case you reactivate.

You agree not to use the Platform to:

• Post false, misleading, or fabricated testimonials
• Record or publish testimonials from individuals who have not provided informed consent
• Harass, defame, or threaten any person
• Violate any applicable law, including privacy legislation
• Attempt to circumvent subscription limits or access controls
• Use automated tools to scrape or bulk-access the Platform
• Infringe on the intellectual property rights of others

We reserve the right to remove any content and suspend or terminate any account that violates these restrictions, without prior notice and without refund.

You, as the subscribing agent, are solely responsible for:

• Obtaining explicit informed consent from each client before initiating a video recording session
• Informing clients that their video will be published publicly on the internet
• Complying with all applicable federal and provincial laws regarding recording consent (including but not limited to PIPEDA and provincial privacy acts)
• Ensuring that no recording involves a minor without appropriate parental or guardian consent

Location 3 Times is not liable for any claim arising from your failure to obtain proper consent.

Your content: You retain ownership of all testimonial videos and associated content generated through your account. By publishing a testimonial through the Platform, you grant Location 3 Times a non-exclusive, worldwide, royalty-free licence to host, display, reproduce, and distribute that content for the purpose of operating and promoting the Platform.

Our platform: All software, design, trademarks, and intellectual property of Location 3 Times remain our exclusive property. Nothing in these Terms transfers any ownership of the Platform to you.

You may remove your licence grant at any time by deleting the testimonial from your dashboard.

When a website visitor submits a contact inquiry through a testimonial page lead form, that lead data (name, email, phone number, comments) is:

• Delivered to you, the subscribing agent, by email notification
• Stored in the Platform database and accessible from your dashboard
• Owned by you for the purpose of following up with that prospect

You agree to use lead data in compliance with PIPEDA and applicable anti-spam legislation (CASL). You may not sell or transfer lead data to third parties without the lead's consent.

We aim for high availability but do not guarantee uninterrupted service. The Platform may be temporarily unavailable due to maintenance, updates, or circumstances beyond our control. We will endeavour to provide advance notice of planned downtime where possible.

We are not liable for any loss of business or revenue resulting from Platform downtime.

To the maximum extent permitted by applicable law, Location 3 Times and its operators, employees, and contractors shall not be liable for:

• Any indirect, incidental, special, consequential, or punitive damages
• Loss of profits, data, business, or goodwill
• Any damage arising from unauthorized access to your account
• Any claim relating to third-party content published on the Platform

Our total liability to you for any claim arising out of these Terms or your use of the Platform shall not exceed the total fees you paid us in the 3 months immediately preceding the claim.

You agree to indemnify, defend, and hold harmless Location 3 Times and its operators from any claim, demand, loss, liability, or expense (including legal fees) arising out of:

• Your use of the Platform
• Content you publish or distribute through the Platform
• Your failure to obtain proper recording consent from clients
• Your violation of these Terms or any applicable law

These Terms are governed by and construed in accordance with the laws of the Province of Ontario and the federal laws of Canada applicable therein, without regard to conflict of law principles.

Any dispute arising under these Terms shall be subject to the exclusive jurisdiction of the courts of Ottawa, Ontario, Canada. If any provision of these Terms is found to be unenforceable, the remaining provisions will continue in full force and effect.

We may update these Terms from time to time. We will notify you of material changes by email at least 30 days before they take effect. If you continue to use the Platform after the effective date of a change, you are deemed to have accepted the revised Terms.

If you do not agree to a change, you must cancel your subscription before the effective date of the change.
